Terms of Service

These Terms govern the sale of goods by POLARDENT d.o.o. ("we", "us") through polardent.store to dental professionals in the European Union. By placing an order you accept these Terms.
1. Who we sell to
polardent.store is a business-to-business (B2B) store. We sell exclusively to registered dental professionals — dentists, dental clinics and dental laboratories — established in Italy, Spain, France and Portugal, acting in the course of their profession or business.
By ordering you confirm that you are a business customer, that you are not acting as a consumer, and that the VAT identification number and business details you provide are accurate. We may verify your professional status and refuse or cancel orders where it cannot be confirmed. The statutory consumer right of withdrawal does not apply (see section 6).
2. Orders & contract formation
Product listings are an invitation to order, not a binding offer. Submitting an order places a binding offer by you to purchase the selected goods. A contract is formed only when we confirm the order by email or dispatch the goods, whichever is earlier.
We may decline an order — for example if a product is unavailable, a price was displayed in error, or your professional or VAT status cannot be verified. If we cannot fulfil an order after payment, we refund the amount received in full.
3. Prices, VAT & invoicing
All prices are shown net, excluding VAT, in euro. For customers with a valid VAT identification number in another EU Member State, intra-Community supplies are invoiced under the reverse-charge mechanism, and you are responsible for accounting for VAT in your Member State. A valid VAT number is required at checkout.
An electronic invoice is issued for every order and made available in your account. Prices may change at any time, but the price confirmed at the time your order is accepted applies to that order.
4. Payment
Payment is due at the time of order through the payment methods offered at checkout. Payments are handled by our payment service provider; we do not store full card details. Goods remain our property until payment has been received in full (retention of title).
5. Shipping & delivery
Shipping costs €10 per order and is free for orders over €150 (net). Orders ship from our supplier, typically within 2–4 business days, to addresses in Italy, Spain, France and Portugal. Delivery times are estimates and not guaranteed.
Risk of loss or damage passes to you on delivery to you or a carrier you have appointed. Please inspect goods on arrival and report visible transport damage promptly (see section 6).
6. Returns, cancellation & warranty
Because you purchase as a business, the statutory 14-day consumer right of withdrawal does not apply. Returns are accepted only under the conditions set out here or where agreed by us in writing.
- Transport damage or wrong item: report within 3 working days of delivery with photos; we arrange replacement or refund at no cost to you.
- Defective goods: the statutory warranty for defects under applicable law applies. Contact us and we will remedy, replace or refund as required by law.
- Sterile, single-use, made-to-order or perishable items cannot be returned once the packaging is opened, for hygiene and safety reasons, unless defective.
Approved returns must be unused, in original packaging, and sent to the address we provide. Return shipping is at your cost unless the return is due to our error or a defect.
7. Liability
Nothing in these Terms excludes or limits liability that cannot be excluded by law (including for death or personal injury caused by negligence, or under product-liability rules). Subject to that, our liability for a contract is limited to the value of the order, and we are not liable for indirect or consequential loss. Goods are supplied for professional use; you are responsible for verifying their suitability for your intended clinical use and for compliance with applicable medical-device and professional regulations.
8. Data protection
We process personal data in accordance with our Privacy Policy, which forms part of these Terms.
9. Governing law & jurisdiction
These Terms and any dispute arising from them are governed by the laws of the Republic of Slovenia, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). The courts of the registered seat of POLARDENT d.o.o. have exclusive jurisdiction, so far as permitted by mandatory law.
